Growth Encouragement Ministries (GEM) Terms and Conditions:

1) Introduction
- Welcome to GEM. This website and any services we offer (collectively, the “Site”) are operated by Growth Encouragement Ministries (GEM), a Texas nonprofit corporation. By accessing or using the Site, you agree to these Terms and our Privacy Policy. If you do not agree, please do not use the Site.
2) About GEM
- GEM is a nonprofit organization organized under the laws of the State of Texas and, where applicable, recognized as a 501(c)(3) charitable organization for federal tax purposes. Our mission is to grow the Kingdom of God by encouraging believers to fulfill their God-given purposes.
3) Acceptance of Terms
- By using the Site, you agree to be bound by these Terms, any additional terms cited herein, and any privacy policy or refund/donation policy posted on the Site. If you do not agree, please discontinue use.
4) Changes to Terms
- We may update these Terms from time to time. We will post the updated Terms on the Site and indicate the “Last Updated” date. Your continued use after changes constitutes acceptance of the updated Terms.
5) What the Site Provides
- The Site offers information about GEM’s mission, programs, news, events, resources, and opportunities to donate or engage with GEM. We may add, remove, or modify features at any time without notice.
6) How you may use the Site
- You may view and use the Site for lawful purposes and in accordance with these Terms.
- Prohibited uses include, but are not limited to: disrupting the Site, infringing on others’ rights, posting illegal or harmful content, soliciting funds outside GEM-approved channels, or misrepresenting your affiliation with GEM.
7) Donations and Giving (If applicable)
- Donations made through the Site are governed by GEM’s Donation Terms and any applicable donor acknowledgment policies. We will provide receipts for donations as required by law. You acknowledge that donations are voluntary and non-refundable except as stated in our donation/refund policy.
- For major gifts or restricted funds, additional terms may apply and will be communicated at the point of donation.
8) Privacy and Data Protection
- Our Privacy Policy explains how we collect, use, store, and share personal information. By using the Site, you consent to our practices described in the policy. We may collect information such as contact details, donation history, event registrations, and site usage data.
9) Intellectual Property
- All content on the Site (text, graphics, logos, video, software, and design) is owned by GEM or its licensors and is protected by law. You may view and print content for personal, non-commercial use, but you may not reproduce, modify, distribute, or create derivative works without GEM’s prior written permission.
10) User Content and Communications
- If you contribute content (comments, testimonials, forum posts, etc.), you grant GEM a non-exclusive, worldwide, royalty-free license to use, reproduce, display, and distribute that content in connection with the Site and GEM’s mission.
- You are responsible for the content you post, and you must not post anything unlawful, false, defamatory, or harmful.
11) Third-Party Links and Content
- The Site may link to third-party sites or include third-party content. GEM has no control over and is not responsible for third-party policies or content. Use such links at your own risk.
12) Liability and Disclaimers
- The Site is provided “as is” and “as available.” To the maximum extent permitted by law, GEM disclaims all warranties, express or implied, including accuracy, reliability, and fitness for a particular purpose.
- GEM is not liable for indirect, incidental, special, or consequential damages arising from your use of the Site or any programs, events, or services.
13) Indemnification
- You agree to indemnify and hold GEM harmless from any claims, losses, damages, or costs arising from your use of the Site or violation of these Terms.
14) Governing Law and Disputes
- These Terms are governed by the laws of the State of Texas, without regard to its conflict of laws principles.
- Any disputes related to these Terms or your use of the Site will be resolved in the state or federal courts located in Texas, as applicable.
15) Compliance with Charitable Solicitation Laws
- If you solicit or engage in fundraising or donation activities through the Site, you agree to comply with applicable federal, state, and local charitable solicitation laws, including Texas Solicitation of Donations Act. We may require registration or disclosures as appropriate.
16) Termination
- GEM may suspend or terminate your access to the Site for violation of these Terms or for conduct that GEM deems harmful or inappropriate, with or without notice.
17) Entire Agreement; Separability
- These Terms, together with GEM’s Privacy Policy and any donation terms or program terms posted on the Site, constitute the entire agreement between you and GEM regarding the Site. If any provision is found unenforceable, the remaining provisions remain in effect.
18) No Waiver
- If GEM fails to enforce a provision of these Terms, it does not constitute a waiver of that or any other provision.
